If 7 or 8 notes (can't remember which) are the exact same in the melody it's plagiarism. He added a different note in between there (literally just one note) so from a legal standpoint it wasn't plagiarism.

I think it's not STEALING, singers are not like that! they're must be a consent of using it from the original singer/artist/writer...
