Out of the millions of pictures on the internet you would never have inclination to use that avatar if it wasn't for John Wilkes Booth, the member of Music Banter. So since he used it first you have to acknowledge that it was his.

It's a picture of the actual John Wilkes Booth. I'd say if it belonged to anyone, it would be him, assuming the artist is dead of course.
