Gray area as ****. What if they're asleep? What if they're too scared, intimidated, or overwhelmed to say anything? There are a lot of cases where someone is unable to say no.

Here's a guideline for determining rape 1: Did two or more people have sex? 2: Did everyone involved want to have sex? 3: If you answered yes to both questions, then it was not rape. If you answered yes to number one and no to number two, it is rape. Imo it's foolproof.
