Not getting a refund means you kept more of your money during the year (kept more of your money to invest). Getting a refund means they took too much out of your paychecks during the year (gave them a free loan).

This is where internet forums advice doesn't outweigh my ****ing lawyer.

Doesn't sound like your lawyer is helping you out though.
