So after reading some tweets some people are complaining that the supreme court stepped beyond their limitations.. if this is true I have mixed feelings about this. I am happy for people getting equal rights but it needs to be done properly.

Please understand I know nothing about this stuff, just looking for some clarification:

I have not really heard anyone raving about it being a landslide. I always consider SCOTUS rulings to be pass/fail. It doesn't really matter what the vote is.

I don't think that's really a valid complaint tbh. A lot of people are harboring on state's rights, but if the SCOTUS comes in and says that what a state or states is/are doing is unconstitutional, then they're well within their boundaries since that's one of the main purposes of the court.

I edited the post explaining what I am confused about.

@Exo - That's a dangerous mind set. It was a great decision but if the government is allowed to just freely change how it acts then people are at risk for when it makes a decision that isn't great, and we will put ourselves in a position to have no way to go against them.

Maybe that's just people who are on this side of the border, lol. Toronto Pride Week 2015 has officially kicked off so people are just super excited. Tons of Americans come up to celebrate.

I think due to legislative gridlock the Supreme Court and lower courts are taking more and more of a proactive role in passing decisions that would otherwise be the responsibility of the legislature. Maybe not so much in a power grab way, but just that certain topics are ignored for so long that it eventually falls to them.

Ending segregation wasn't due to passing any laws either, but because of a court decision that was dubious at best (Brown v. Board of Education). The idea that the Commerce Clause in the Constitution, which governs interstate commerce, should have anything to do with segregation is a very big stretch, so I think it could very well be argued that it was bad law, even if the outcome was desirable.

I can't fault the Court for deciding the way it did though, since if I was Supreme Court Justice, and the decision on whether or not to uphold segregation fell into my lap, I really can't say that I could remain totally impartial.

I addressed the state's rights issue in my post, but as far as the unelected judges part goes...there were actually 9 unelected judges that voted on the issue since the public doesn't elect them to office. Choosing justices is done on the part of the executive branch and approved by the legislative branch.

Like I said, I don't really think it's a valid complaint and most people who are using it are hiding behind those arguments so as not to oust themselves as bigots.

Okay. Thanks. So it wasn't actually the Supreme Court stepping beyond it's means, which was my concern. I don't follow politics or government shit, so I'm pretty dense about this kind of stuff.
