alright, so you're saying if the majority supports gay marriage, then the supreme court should uphold it

if the majority doesn't support gay marriage, then the supreme court should leave it to the states

which would then be free to legalize it or ban it as they see fit?

or should the supreme court legalize gay marriage regardless of what the populace thinks because... equality?

The discussion is about what scotus does do, not what they should do. Completely different discussions.

alright.. but my point was that i don't think the supreme court rules on the basis of popular opinion... so then the fact that the majority of the national populace happen to support decision the supreme court made is basically irrelevant.

Maybe not popular opinion but certainly their individual consciousness comes into play in their final rulings. And that's fueled in part by the popular will of the public.
