From what I understand, banning is done in a democratic way with several mods deciding what should be done, so no one person has the power. For example as you know and mentioning no names, there is currently a troll going around at the moment making inflammatory statements and then makes no attempt to substantiate his point of view, but in his defence, he's not rude or insulting so infractions against him will be harder to apply.
