That's actually a good question. In California at least, and where I live in particular, it's hardly illegal. Recently the governor made it so that possession of less than an oz of marijuana is no longer a misdemeanor, just an infraction. Basically that means getting caught smoking is no worse than getting caught jaywalking or littering. In fact, in most cases getting caught with marijuana would be better than getting caught littering. That's in California though, don't know what it's like in other states. I've actually been "caught" smoking by the police before, but he didn't do anything, just sort of wagged his finger at me. If I was driving I'm sure it would've been different though. It's sort of an unwritten rule in my city that the cops won't arrest you for marijuana possession, unless you're doing something stupid or dangerous. Again, that's just my city's police department, if you were in a more conservative city I'm sure it would be different.
Basically marijuana exists in a legal gray zone in California, I mean it was almost legalized here last November.
