I think spelling variation are easier for copyright purposes. e.g. P!nk, she doesn't have to worry about Victoria Secret suing her for having "Pink" clothing/concert tees - however unlikely that might be.
As far as Ke$ha "retreading" the Cleopatra
a la trailer park look, I think she could be "retreading" the "
I just step out of the pool" Linda Carter look.
