The criminal probe into Weiner's emails concerned only the emails related to him communicating with a minor. When they noticed there was stuff from Clinton they needed to get a warrant to legally obtain those emails so they can go through them. Comey admitted they hadn't gone through them yet because that would have been against the law without a warrant.
Since they haven't even gone through the emails yet and don't know what's in them it's not a criminal probe. If they find a single incriminating email they'll immediately turn it into a criminal investigation.
It's the same as what happened the first time around.
Using the word criminal at this point is premature and very assumptive.
